The consumer submits a completed complaint application against a financial institution <strong><a href=\"https:\/\/financialombudsman.org.cy\/en\/complaints-submission-and-mediation-requests\/submission-of-a-complaint-by-natural-persons\/\">online<\/a>\u00a0<\/strong>or\u00a0<a href=\"https:\/\/financialombudsman.org.cy\/wp-content\/uploads\/2025\/03\/Complaint-Submission-Form-for-Natural-Persons.pdf\" target=\"_blank\" rel=\"noopener\"><strong>in paper form<\/strong><\/a>. A fee of \u20ac20 is paid when submitting the complaint.<\/p>\n<p>The complaint, provided that it meets the criteria for submission and examination, in accordance with the provisions of the relevant legislation (Law 84(I)\/2010), will be examined by the competent officers of the Agency. Subsequently, a relevant decision on the complaint will be issued by the Financial Ombudsman, which will be notified to the consumer and the financial institution. The term complaint also includes the complaint submitted by an eligible debtor for confirmation of the required mortgage debt prior to the foreclosure process in accordance with the Transfer and Mortgage of Real Estate Law.<\/p>\n<\/details>\n<details>\n<summary class=\"purple\">What does &#8220;Consumer&#8221; as defined in article 2 of the Practice of Insurance Business and Other Related Matters Law and carries out intermediation activities in the insurance sector.<\/p>\n<\/details>\n<\/div>\n<p>[\/vc_column_text][vc_empty_space height=&#8221;80px&#8221;][\/vc_column][\/vc_row][vc_row el_id=&#8221;submission-requirements&#8221;][vc_column][vc_empty_space height=&#8221;80px&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>Submission requirements<\/h2>\n<ul>\n<li>The complaint is filed by a consumer against a financial company.<\/li>\n<li>The consumer is a<strong> natural person<\/strong>\u00a0who is not in bankruptcy.<\/li>\n<li>The complaint concerns a protest or objection or a difference of up to <strong>\u20ac250.000<\/strong>.<\/li>\n<li>The consumer must have previously submitted his complaint in writing to the Financial Institution within\u00a0<strong>6 months<\/strong> from the date on which he became aware or should reasonably have become aware of the harmful act.<\/li>\n<li>The complaint is submitted to the Financial Commissioner within the following timeframes:\n<ul>\n<li><strong>12 months<\/strong>\u00a0\u2013 from the date on which the consumer submitted a complaint to the Financial Institution.<\/li>\n<li><strong>18 months<\/strong> \u2013 from the date on which the consumer became aware or should reasonably have become aware of the difference.<\/li>\n<\/ul>\n<\/li>\n<li>The transaction falls within the supervisory responsibilities of the competent supervisory authorities, namely the Central Bank of Cyprus or the Cyprus Securities and Exchange Commission or the Insurance Commissioner.<\/li>\n<li>The eligible debtor\/consumer pays a fee of \u20ac20 when submitting his Complaint to the Commissioner.<\/li>\n<\/ul>\n<h3><strong>Complaints that are not examined:<\/strong><\/h3>\n<ul>\n<li>Complaints for which a relevant decision has already been issued by a Court of the Republic.<\/li>\n<li>Complaints for which any legal proceedings are ongoing unless permission\/order to postpone the legal proceedings has been granted by the court.<\/li>\n<li>Complaints that have already been examined by another alternative dispute resolution body.<\/li>\n<li>Complaints that are malicious and the resulting difference is not immaterial.<\/li>\n<\/ul>\n<p>[\/vc_column_text][vc_empty_space height=&#8221;80px&#8221;][\/vc_column][\/vc_row][vc_row full_width=&#8221;stretch_row&#8221; The document must include the date of submission, the details of dispatch and the proof of dispatch, i.e. email or seal of receipt on the letter.<\/li>\n<li>Acknowledgment of receipt of complaint by the financial institution, including the Unique Reference Number (&#8216;URN&#8217;) (where applicable). The document must include the URN (where applicable), the email addresses, and date or seal of receipt by the financial institution.<\/li>\n<li>A copy of the response letter received from the financial institution. If the response was received via email, the copy of the email must include the email addresses and the dates.<\/li>\n<li>A copy of the agreement that relates to the complaint (if this is in your possession).<\/li>\n<li>Any other documents that pertain SOLELY to this complaint.<\/li>\n<\/ol>\n<p>[\/vc_column_text][vc_empty_space height=&#8221;80px&#8221;][\/vc_column][\/vc_row][vc_row full_width=&#8221;stretch_row&#8221; css=&#8221;.vc_custom_1743673813002{background-color: #EFF0F1 !important;}&#8221; el_id=&#8221;endexomena-meta-tin-ipovoli&#8221;][vc_column][vc_empty_space height=&#8221;80px&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2><strong>Possibilities after filing a complaint<\/strong><\/h2>\n<h3><strong>Registration of a lawsuit by the consumer after submitting a complaint<\/strong><\/h3>\n<p>If the consumer files a complaint with the Commissioner and later files a lawsuit against the financial institution on the same matter, he must inform the Commissioner on the same day about the lawsuit. If the Commissioner learns of the lawsuit (whether through the consumer\u2019s notification or otherwise), he stops examining the complaint and informs the financial institution accordingly.<\/p>\n<p>The debtor in question may request the Commissioner not to terminate the procedure and to examine the complaint before the Court\u2019s decision is issued, with a view to resolving the complaint out of court, where possible, and in such a case, the eligible debtor shall inform the Court accordingly in any pending procedure.<\/p>\n<h3><strong>Settlement of a dispute between involved parties<\/strong><\/h3>\n<p>If the parties involved in the complaint agree to resolve the dispute, they must notify the Commissioner and provide him with details of their agreement. Once the Commissioner receives these notifications and confirms that the agreed compensation has been paid to the consumer, he stops examining the complaint.[\/vc_column_text][vc_empty_space height=&#8221;80px&#8221;][\/vc_column][\/vc_row][vc_row el_id=&#8221;decision-issuance&#8221;][vc_column][vc_empty_space height=&#8221;80px&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2><strong>Decision Issuance<\/strong><\/h2>\n<ul>\n<li>The Commissioner&#8217;s decision is issued in writing within 90 days from the date of receipt of the complete complaint file. Exceptionally and in particularly complex circumstances, the deadline may be extended.<\/li>\n<li>If the Commissioner&#8217;s decision is in favor of the consumer, the Commissioner determines the financial compensation to be paid by the financial undertaking to the consumer, which he considers fair for the actual financial damage suffered by the consumer and which may not exceed \u20ac100.000. If the Commissioner considers that fair compensation should have been higher, he may recommend that the financial undertaking pay the consumer, voluntarily, the additional difference.<\/li>\n<\/ul>\n<p>[\/vc_column_text][vc_empty_space height=&#8221;80px&#8221;][\/vc_column][\/vc_row][vc_row full_width=&#8221;stretch_row&#8221; css=&#8221;.vc_custom_1747747386790{background-color: #EFF0F1 !important;}&#8221; el_id=&#8221;boundness&#8221;][vc_column][vc_empty_space height=&#8221;80px&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2><strong>Boundness<\/strong><\/h2>\n<p>The Commissioner&#8217;s decision\u00a0<strong>is binding only if both parties accept it<\/strong>. The interested parties must notify the Commissioner in writing,\u00a0<strong>within two months<\/strong>, whether they accept the decision. If the 2 months pass without both parties notifying whether they accept the binding nature of the decision, then the decision\u00a0<strong>is not considered binding<\/strong>.\u00a0Since the Commissioner&#8217;s decisions do not become binding without acceptance by both parties, when the findings are in favor of the consumer, the Office as an Out-of-Court Dispute Resolution Body, at the stage either before the issuance of the Decision or even after, makes efforts to reach a compromise solution between the interested parties, where and where there is goodwill on both sides.<\/p>\n<p>In case the decision is accepted by the parties involved, the Financial Institution must comply with the decision\u00a0<b>within one month<\/b>\u00a0of its acceptance.
