{"id":1120,"date":"2025-01-22T15:08:44","date_gmt":"2025-01-22T13:08:44","guid":{"rendered":"https:\/\/financialombudsman.org.cy\/?page_id=1120"},"modified":"2025-06-05T15:29:30","modified_gmt":"2025-06-05T12:29:30","slug":"faqs","status":"publish","type":"page","link":"https:\/\/financialombudsman.org.cy\/en\/faqs\/","title":{"rendered":"FAQ&#8217;s"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row el_id=&#8221;faqs-consumers-complaints&#8221;][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>Complaints against financial institutions<\/h2>\n<p>[\/vc_column_text][vc_tta_accordion section_title_tag=&#8221;h5&#8243; color=&#8221;white&#8221; active_section=&#8221;&#8221; no_fill=&#8221;true&#8221; collapsible_all=&#8221;true&#8221;][vc_tta_section title=&#8221;What are the responsibilities of the Financial Commissioner?&#8221; tab_id=&#8221;what-are-the-responsibilities-of-the-financial-commissioner&#8221;][vc_column_text css=&#8221;&#8221;]The Financial Commissioner (Ombudsman) is an independent institution that examines consumer complaints (natural and legal persons) against financial enterprises such as banks, credit acquisition companies, investment companies, insurance companies, etc.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What types of complaints can the Commissioner examine?&#8221; tab_id=&#8221;types-of-complaints-the-commissioner-examines&#8221;][vc_column_text css=&#8221;&#8221;]<strong>The Financial Commissioner (Ombudsman) may examine complaints related to:<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">loans, whether they are performing or non-performing,<\/li>\n<li aria-level=\"1\">bank accounts (current, savings, cards, etc.),<\/li>\n<li aria-level=\"1\">credit and debit cards,<\/li>\n<li aria-level=\"1\">investment accounts and investment services,<\/li>\n<li aria-level=\"1\">insurance products.<\/li>\n<\/ul>\n<h3><span class=\"purple\"><strong>Examples of complaints<\/strong><\/span><\/h3>\n<p><strong>For Licensed Credit Institutions (ACI) and Credit Acquisition Companies (CACs)<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">Excessive charges resulting from illegal interest rate changes (base rate and margin), abusive clauses or illegal charges of expenses and commissions.<\/li>\n<li aria-level=\"1\">Non-transparent practices.<\/li>\n<li aria-level=\"1\">Transaction disputes.<\/li>\n<li aria-level=\"1\">Early loan repayment.<\/li>\n<\/ul>\n<p><strong>For investment companies (CIFs)<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">Aggressive sales tactics \/ misleading information.<\/li>\n<li aria-level=\"1\">Providing incorrect investment advice.<\/li>\n<li aria-level=\"1\">Incorrect assessment of the consumer&#8217;s suitability for investment.<\/li>\n<li aria-level=\"1\">Incorrect classification of a client as a professional investor.<\/li>\n<li aria-level=\"1\">Provision of unsuitable financial instruments or investment services to the consumer.<\/li>\n<li aria-level=\"1\">Failure to execute an order.<\/li>\n<li aria-level=\"1\">Incorrect execution of transactions.<\/li>\n<li aria-level=\"1\">Inability to access the account.<\/li>\n<li aria-level=\"1\">Expenses\/charges.<\/li>\n<\/ul>\n<p><strong>For Insurance Companies\u00a0<\/strong><\/p>\n<ul>\n<li>Complaints regarding home, life, health, car, travel insurance, etc.<\/li>\n<li aria-level=\"1\">Non-payment of a claim.<\/li>\n<li aria-level=\"1\">Buyout of an insurance policy.<\/li>\n<li aria-level=\"1\">Unilateral cancellation \/ modification of contract.<\/li>\n<li aria-level=\"1\">Refusal or delay in cashing out a contract.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Who can file a complaint?&#8221; tab_id=&#8221;who-can-file-a-complaint&#8221;][vc_column_text css=&#8221;&#8221;]<strong>Individuals and organizations that are considered \u201cconsumers\u201d can file a complaint. If they do not respond within a reasonable amount of time or you are not satisfied with the response, you can appeal to the Financial Ombudsman within 12 months from the date of your complaint.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What are the required documents that I must provide when submitting a complaint to the Financial Ombudsman?&#8221; tab_id=&#8221;required-documents&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<h3><strong>A. For Natural Persons<\/strong><\/h3>\n<ol>\n<li aria-level=\"1\">Receipt of payment of the complaint fee (\u20ac20).<\/li>\n<li aria-level=\"1\">Copy of Identity Card or Alien Registration Card (ARC) or Copy of Passport.<\/li>\n<li aria-level=\"1\">If the complaint is submitted by a representative: Power of attorney with original certification.<\/li>\n<li aria-level=\"1\">Copy of a complaint submitted to the financial company.<\/li>\n<li aria-level=\"1\">Notification of receipt of the complaint.<\/li>\n<li aria-level=\"1\">Copy of the financial institution&#8217;s response (if provided).<\/li>\n<li aria-level=\"1\">Copy of relevant contract or agreement (if any).<\/li>\n<li aria-level=\"1\">Any other relevant document supporting the complaint.<\/li>\n<\/ol>\n<h3><strong>B. For Legal Entities \/ Organizations \/ Foundations, etc.<\/strong><\/h3>\n<p>They submit all of the above (1\u20138) and the following in addition:<\/p>\n<ol>\n<li aria-level=\"1\">Certificate of incorporation of a legal entity.<\/li>\n<li aria-level=\"1\">Board of Directors decision or authorization for representation.<\/li>\n<li aria-level=\"1\">Copy of Identity Card or Alien Registration Card (ARC) or Copy of Passport of legal representative.<\/li>\n<li aria-level=\"1\">One of the following (for financial data):<\/li>\n<\/ol>\n<ul>\n<li aria-level=\"1\">Documentary evidence or Certificate from a member of ICPAC (Cyprus Institute of Certified Public Accountants), regarding turnover \/ annual income \/ net assets or<\/li>\n<li aria-level=\"1\">Audited financial statements of the previous year.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What conditions must be met for my complaint to be examined by the Financial Ombudsman?&#8221; tab_id=&#8221;conditions-for-examination&#8221;][vc_column_text css=&#8221;&#8221;]<strong>For a complaint to be accepted:<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">It must concern a dispute or protest of up to \u20ac250,000.<\/li>\n<li aria-level=\"1\">A written complaint must have been made to the financial institution within six months from the moment the consumer received or should have received knowledge of the act.<\/li>\n<li aria-level=\"1\">The complaint must be submitted to the Financial Commissioner:\n<ul>\n<li aria-level=\"2\">Within 12 months of submitting the complaint to the financial institution, or<\/li>\n<li aria-level=\"2\">Within 18 months from the time the consumer became aware or should reasonably have become aware of the difference.<\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\">The transaction falls within the supervisory responsibilities of the Central Bank, the Securities Commission or the Insurance Commissioner.<\/li>\n<li aria-level=\"1\">No Court decision has been issued on the same matter and no legal proceedings are pending (unless they have been suspended).<\/li>\n<li aria-level=\"1\">It must not have been examined by another dispute resolution body.<\/li>\n<li aria-level=\"1\">It should not be malicious or trivial.<\/li>\n<li aria-level=\"1\">The consumer must pay a fee of \u20ac20 upon submitting the complaint and provide all required documents.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;After I file a complaint with the Commissioner, can I file a lawsuit regarding the same matter?&#8221; tab_id=&#8221;complaint-filing-and-litigation&#8221;][vc_column_text css=&#8221;&#8221;]Yes, you can file a lawsuit before a Court, even after submitting a complaint to the Financial Ombudsman. However, you are required to notify the Ombudsman on the same day that the lawsuit has been filed.<\/p>\n<p>After being notified or otherwise informed of the initiation of legal proceedings, the Commissioner terminates the examination of the complaint and informs the financial undertaking accordingly.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;When can the Commissioner handle a complaint when there are ongoing legal proceedings?&#8221; tab_id=&#8221;complaint-ongoing-legal-proceedings&#8221;][vc_column_text css=&#8221;&#8221;]When both parties agree and receive permission from the Court to postpone the proceedings, in order to appeal to the Commissioner for an out-of-court settlement. The postponement cannot exceed four months.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;How long does the complaint review process take?&#8221; tab_id=&#8221;review-process-time&#8221;][vc_column_text css=&#8221;&#8221;]The process is usually completed within 90 days from the date the Commissioner receives all the necessary documents and evidence. In more complex cases, the duration may be extended.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What are the possible outcomes of my complaint?&#8221; tab_id=&#8221;possible-outcomes&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<ol>\n<li><strong>Decision in favor of the Consumer\u00a0<\/strong>\n<ul>\n<li>Recommendation for compensation of up to \u20ac100,000 or other corrective actions.<\/li>\n<li>Recommendation to the financial company for payment of additional compensation.<\/li>\n<li>Recommendation for measures to be taken to resolve the problem.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Decision to reject the complaint\u00a0<\/strong><\/li>\n<li><strong>Friendly settlement<\/strong>\n<ul>\n<li>The matter is resolved amicably and the complaint is closed without a decision being issued.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Complaint termination\u00a0<\/strong>\n<ul>\n<li>The complaint does not meet the criteria and conditions.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Is the decision of the Financial Commissioner binding?&#8221; tab_id=&#8221;boundness-of-decision&#8221;][vc_column_text css=&#8221;&#8221;]Not automatically. The Commissioner&#8217;s decision becomes binding only if both parties (the consumer and the financial institution) accept it in writing. Acceptance of the decision by both parties makes it final and not subject to appeal before a Court.<\/p>\n<ul>\n<li aria-level=\"1\">The parties have two months from the issuance of the decision to declare whether they accept it.<\/li>\n<li aria-level=\"1\">If they do not respond within the deadline, it is considered that they reject it.<\/li>\n<li aria-level=\"1\">If both parties accept it, the financial institution must comply within 1 month of acceptance.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What can I do if the financial company does not accept the Commissioner&#8217;s decision?&#8221; tab_id=&#8221;financial-company-not-accepting-decision&#8221;][vc_column_text css=&#8221;&#8221;]If the financial institution does not accept the decision, it is not binding on it. In such a case, you have the right to appeal to the Courts, if you consider it necessary. However, the Office of the Financial Ombudsman has no authority to become involved in any legal proceedings, nor to provide legal advice.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Can I appeal or complain about the Financial Commissioner&#8217;s decision or procedure?&#8221; tab_id=&#8221;appeal-decision&#8221;][vc_column_text css=&#8221;&#8221;]The decision of the Financial Commissioner is final and not subject to appeal or revision. Mediation provides an opportunity for borrowers and licensed institutions to discuss and reach a mutually acceptable and sustainable solution, such as a modification of the terms of the loan, an extension of the repayment period, a reduction in the interest rate or a full settlement. Through this process, time-consuming and costly legal proceedings are avoided, communication is enhanced and the timely settlement of debts is promoted before they reach extreme measures, such as foreclosures.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What requirements are needed to apply for the appointment of a mediator?&#8221; tab_id=&#8221;1747809174994-64547fb2-2d50&#8243;][vc_column_text css=&#8221;&#8221;]To apply for appointment as an intermediary by the Financial Ombudsman, all of the following must apply:<\/p>\n<ul>\n<li>The credit facility is in arrears or overdue.<\/li>\n<li>The credit facility should concern:\n<ul>\n<li>Loan, overdraft, credit card or financial leasing.<\/li>\n<li>An initial contractual obligation of up to \u20ac350,000.<\/li>\n<li>Security by a mortgage on a primary residence or business premises.<\/li>\n<\/ul>\n<\/li>\n<li>The assessed value of the property should not exceed:\n<ul>\n<li>\u20ac350,000 for a main residence.<\/li>\n<li>\u20ac750,000 for a commercial building.<\/li>\n<\/ul>\n<\/li>\n<li>There is no:\n<ul>\n<li>Court decision on the dispute.<\/li>\n<li>Ongoing legal proceedings<\/li>\n<li>Auction process for the property underway.<\/li>\n<\/ul>\n<\/li>\n<li>The credit facility must not have been terminated.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;When can I apply for mediation?&#8221; tab_id=&#8221;1747809175023-5a9ef35d-9718&#8243;][vc_column_text css=&#8221;&#8221;]The application must be submitted:<\/p>\n<ul>\n<li>Within\u00a0<strong>14 days<\/strong>\u00a0of submitting the Personal Financial Statement (PFS) or audited financial statements to the licensed institution, or<\/li>\n<li>Within\u00a0<strong>30 working days<\/strong>\u00a0from:\n<ul>\n<li>the submission of a first restructuring proposal or<\/li>\n<li>the sending of a negative response from the licensed institution, or<\/li>\n<li>the passage of\u00a0<strong>six months<\/strong> without a proposal from the licensed institution after the PFS.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;How is \u201cprimary residence\u201d defined for mediation purposes?&#8221; tab_id=&#8221;1747809175052-636ccacc-ef11&#8243;][vc_column_text css=&#8221;&#8221;]The &#8220;main residence&#8221; is the residence used for the residence of its owner or the residence under construction and intended for the same purpose. In the case of a financial leasing contract, the main residence is understood to be the residence used by the lessee of the contract. The use must concern a period of at least six months per year.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;How is &#8220;business premises&#8220; defined for mediation purposes?&#8221; tab_id=&#8221;1747809175079-192fbbf3-edda&#8221;][vc_column_text css=&#8221;&#8221;]&#8221;Business premises&#8221; is defined as a property used for housing and conducting the business and\/or commercial activities of the debtor&#8217;s business. This property must be necessary for the continued operation of the business.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;How is the assessed value of the residence\/business premises proven?&#8221; tab_id=&#8221;1747809175105-015c4aa2-3496&#8243;][vc_column_text css=&#8221;&#8221;]Through valuations by registered ETEK (Cyprus Scientific and Technical Chamber) member valuers, made within two years prior to the application. If there are two valuations with a deviation of up to 25%, the average is taken.
